BUSINESS LEGAL HEALTH CHECK

Diagnostic privacy notice

Updated October 2026. This notice covers the questionnaire and its diagnostic review.

Who is responsible?

Sethu Mkhwanazi Attorneys Inc. (SMA), Regus – Durban Country Club, 101 Isaiah Ntshangase Road, Stamford Hill, Durban, is responsible for the information collected for this diagnostic. Contact admin@sethumkhwanaziattorneys.co.za or 031 007 6324 with privacy enquiries.

What we collect and why

The form collects your name, business name, email, phone number, business details, reported legal arrangements, concerns, referral source and follow-up preferences. SMA uses these to review your business’s reported position, request clarification, prepare and email your Business Legal Readiness Report and discuss assistance you request.

Participation is voluntary. Fields marked with an asterisk are required to submit the questionnaire; without them SMA cannot complete this diagnostic process. Avoid identity numbers, third-party names, confidential documents and sensitive dispute details. No document uploads are requested.

The business name and email address are also used to identify repeat submissions. Submitting does not subscribe you to marketing or create a mandate for further legal work.

Who can access the information?

Submitted answers are available in SMA’s restricted review workspace. They are not published in the Business Legal Essentials guide or made available to other respondents. SMA may export a questionnaire for its review and report preparation. SMA may also view a limited summary in its private Growth Studio to organise follow-up about the diagnostic: submission reference, business name, contact name, email address and referral channel. The summary connection excludes full questionnaire answers and report content and does not subscribe you to marketing.

This site is hosted through OpenAI Sites using Cloudflare infrastructure. Hosting, storage, security and email service providers may process information to provide those services. Their systems may process information outside South Africa. See OpenAI’s privacy policy and Cloudflare’s data processing terms for their published protections; contact SMA for questions about this diagnostic’s processing arrangements.

The questionnaire does not automatically generate a report or send your answers to an AI model. SMA reviews the diagnostic separately.

Saving and viewing your answers

Answers are saved only when you submit. Unsubmitted answers are held in the open page and may be lost if you close or refresh it.

After submission, an essential browser cookie enables access to your saved questionnaire in the same browser without an account. It lasts up to one year. Clearing cookies or using another browser may remove that access, but does not delete SMA’s saved copy. Anyone using the same browser profile may be able to open your receipt, so take care on shared devices.

There are no advertising or analytics trackers added by this questionnaire. The hosting platform may use its own operational logs and security technologies.

How long we keep diagnostic records

For diagnostics that do not become client matters, SMA reviews retention 12 months after submission. Records no longer needed for the diagnostic or another lawful purpose should then be deleted or de-identified. Longer retention may apply where necessary for an ongoing enquiry, a legal obligation or the establishment, exercise or defence of a legal claim. Client matters are handled under the applicable client-file retention arrangements.

The 12-month point is a manual review, not automatic deletion. It includes considering exported questionnaire copies and diagnostic reports.

Your choices and rights

You may contact SMA to request access to your information, correction of inaccurate information, or deletion where applicable, or to object to processing where the law allows. SMA may need to verify your identity and consider lawful retention obligations. A submitted questionnaire is locked in the app; contact SMA if a correction is needed.

You may also lodge a complaint with the Information Regulator: POPIAComplaints@inforegulator.org.za, telephone 010 023 5200.
